Disrepair, Right and Remedies

A landlord and tenant have statutory rights and obligations in relation to assured tenancies, assured shorthold tenancy agreements or in Wales, occupation contracts. These are rights and obligations imposed by legislation. There can also be further rights and obligations on a landlord and tenant imposed by the terms of the tenancy agreement or occupation contract.

A landlord of residential property will usually have repairing obligations applying to them automatically under the legislation and there are various pieces of legislation governing these obligations. These are known as implied terms, meaning that these repairing obligations are automatically implied terms of the tenancy agreement, even if the tenancy agreement does not refer to these obligations. 

A tenant also has rights relating to the condition of the let property, such as a right to claim damages in circumstances where the landlord is in breach of their repairing obligations.
